Conveyancing Simi Valley

What exactly is conveyancing?

Conveyancing refers to the law that deals with the legal aspects of moving house. Lawyers who specialize in moving homes are called conveyancers. Conveyancers will help you in the process of transferring property ownership from one party to another.

The Conveyancing Process

Two major stages of conveyancing are exchange and completion. The entire process takes a lot of time often requiring several weeks and months before the process is completed. The Conveyance process begins once an offer on your property has been accepted by all parties involved. The estate agent will send the conveyance lawyer a copy of the ‘Memorandum of sale’ which includes key information about the property itself and the offer which was accepted. The conveyance lawyer will need to be provided with official proof of ID such as a passport or driving license to confirm the person buying the property is providing a valid form of Identify. The second part of the process is to confirm with the conveyance lawyer that you have a mortgage lender who willing to lend you the amount set out in the agreed offer.

The next step is hiring a building surveyor who will determine the value of the property. Please refer to the ‘building surveyor’ section of our Los Angeles service provide listings for more information on how a building surveyor can help you in the property buying process. A building surveyor plays an important role in the Conveyance process as most properties which are purchased with a mortgage will require conveyancing/ property searches to be carried out on the property which aim to identify any problems with property. The Mortgage lender will often establish a conveyance search as part of the mortgage agreement as a conveyance search provides them with a lot of key information related to the value of the property. For example this could be information related to the physical condition of the property’s water and drainage system or a property’s value may be hindered with the discovery that a loft conversion doesn’t meet legal requirements to be used as another bedroom. A conveyance search would also include a search relating to the local environment and whether the property’s value is hindered by being at risk of flooding or limited access to good internet speeds. The next step in the process is for the conveyancers representing both the buyers and the sellers to raise questions with each other to establish a foundation in which a legal report is produced. The legal report will basically be a draft version of the ‘contract of sale’ and it’s important that both the seller and buyer read the contract carefully before signing it and a notary public should be on hand to witness the signing of the contract which transfers ownership of the property. Both the buyer and seller are legally bound to fulfill the contract by the deadline agreed upon after the contracts are exchanged. Usually, the conveyancers exchange the contracts via telephone. Then they send out the signed documents by mail. Your conveyancer will legally sign both the buyer and the seller to transfer the property. Your lender will request mortgage monies and paperwork will then be prepared for completion.
